Will Lay's Corpse Serve His Prison Time?

Federal prosecutors are seeking to send Enron founder Ken Lay's casket to prison so he can serve his time anyway, even though he's now dead.

"It's only fair, since the government spent millions in taxpayer money to see that Lay and ex-Enron chief executive Jeff Skilling were brought to justice," said Harold Rubenstein, a spokesman for the U.S. Justice Department in Washington, D.C.

In what many considered a major dose of karma, Lay suffered a massive coronary and died while awaiting sentencing for fraud and conspiracy. Legal experts said he was looking at 25 to 40 years in prison.

"We think Lay, er, Lay's casket, should do whatever time the judge was going to give him," Rubenstein said. "The guy looted the company and caused untold numbers of employees to lose their jobs and life savings."

Even though he was convicted in May, Lay "obviously wasn't suffering too much. My goodness, he died in Aspen, Colorado, which ain't exactly Skid Row," Rubenstein said.

"We think it's appropriate that Lay do some time, even if it's only his corpse," Rubenstein said. "Quite honestly, the government wants and needs its pound of flesh, so to speak."

A Lay family spokesman said he was outraged by the government's position.

"Do they have no shame? Will they allow him no dignity and to just die in peace?" said spokesman Homer Proulx. "They hounded him for the past few years. Can't they let up on him in death?"

"No," Rubenstein said. "We don't care that he was President Bush's buddy, Kenny Boy, and raised campaign funds for him in the past. We just want him brought to justice, plain and simple.

"After all he did, he doesn't deserve any dignity," Rubenstein said. "Sure, it's unprecedented to send a casket to prison. But we need to send a message that corporate thievery won't be tolerated, even after death."

The judge said he would take the government's request under advisement and issue a ruling on the day of Skilling's sentencing.
